Two clauses of the AI Diffusion rule ask for an applicant’s account of how it can verify, for example from ping times, that its chips have not left the authorised country, and for software and hardware that detect and defeat tampering. The rule has been unenforced since May 2025, though the eCFR still printed it on 5 October 2026.

How the timeline is drawn

The axis runs from October 2022 to October 2026; the 4 records dated earlier are drawn left of the dotted rule, in date order, under “Earlier”.

A date known only to the month or the year is drawn at the middle of that month or year, and marks that would touch stack in rows within their lane, earliest first. The selected record’s line runs through its dated steps, each ticked, to its end or, for a text in force or pending, to the last check.

The 2 undated records are not drawn; they are in the register and the card’s record list.

Reported; text unpublished: 8 measures, 1 investigation and 1 company letter known only from the press.

A record known only from the press is drawn at the date of the report.

ANS #2, Sec. 6(a)(1), printed pp. 10-11 · as ordered reportedIts ask: Requires a mechanism, hardware or other · on location verification, reporting, licence conditions and enforcement

Within one year Commerce must require covered datacenter chips exported abroad to be secured by a chip security mechanism that can reliably show they were not diverted to destinations of concern (D:5 or as determined); the substitute’s definition (Sec. 3(2)) lets periodic on-site audits and owners’ attestations serve as one. Proposed regulations are due within 270 days and a final rule within one year, including a duty to report to the US Bureau of Industry and Security (BIS) whenever mechanisms fail to confirm non-diversion or show tampering.

> \[…\] shall require any covered integrated circuit product that is exported, reexported, or in-country-transferred to or within a foreign country to be secured by a chip security mechanism that enables reliable verification of whether the product has been illegally diverted to destinations of concern \[…\]

What the Chip Security Act would mandate

- Before the committee adopted the amended text (26 March 2026): ‘blanket mandates for new, untested, and potentially infeasible on-chip mechanisms’ (SIA, 2 March 2026 · [semiconductors.org](https://www.semiconductors.org/sia-statement-on-chip-security-act/)). After it: ‘bespoke location-verification hardware or software’ (NBC, 18 June 2026 · [nbcnews.com](https://www.nbcnews.com/tech/tech-news/chips-security-act-gains-industry-support-letter-rcna350500) · Press reporting); ‘mandating geotracking’ (Crypto Briefing, 19 July 2026 · [cryptobriefing.com](https://cryptobriefing.com/export-control-bills-ndaa-crypto-mining/) · Press reporting); ‘government-mandated chip tracking’ (ITI and four other trade associations, 3 September 2026 · [itic.org](https://www.itic.org/documents/NDAAExportControlsLetter.pdf)).

- The introduced 2025 text ([govinfo.gov](https://www.govinfo.gov/content/pkg/BILLS-119hr3447ih/html/BILLS-119hr3447ih.htm)) required ‘location verification’ within 180 days, and mandatory secondary mechanisms. The committee-adopted text (ANS #2 · [democrats-foreignaffairs.house.gov](https://democrats-foreignaffairs.house.gov/_cache/files/c/4/c4ae9d78-e77d-4679-940c-3843f3852092/C19CC67924D6EC7D1E3F7DBBD881CBE20ADA1803ED8F0307233E82737CF8805B.huizenga-ans-2-to-hr-3447.pdf)) and S.Amdt. 6105 ([govinfo.gov](https://www.govinfo.gov/content/pkg/CREC-2026-06-24/html/CREC-2026-06-24-pt1-PgS3312-2.htm)): ‘chip security mechanism’ includes on-site audits, attestations by U.S.-headquartered owners, or ping-based location verification against a trusted landmark server; the Act may not be construed to mandate a location-verification mechanism requiring physical hardware changes, nor kill switches or geofencing.

Only published texts are counted, which leaves out the unpublished conditions of export licences, among them the H200 licences and the November 2025 approvals for G42 and Humain.

The Gulf agreement texts and China’s reported restrictions on purchases of NVIDIA chips are unpublished. Their records rely on announcements, NVIDIA’s filings and press reports.

1. The Affiliates Rule (50 percent ownership extension of Entity List restrictions) and its November 2025 suspension, which runs through 9 November 2026 in the text of Part 744 on the US Bureau of Industry and Security’s (BIS) site; China’s Ministry of Commerce (MOFCOM) states the Kuala Lumpur arrangement is extended to 10 January 2027; searches of US government sites on 8 October 2026 found no such extension · Unverified · the searches

The searches: In the text of Part 744 on BIS’s site, current to 7 October 2026, the stay on section 744.8 and the other suspended provisions runs through 9 November 2026. Searches of US government sites found no extension to January 2027.

2. Taiwan: the Ministry of Economic Affairs’ (MOEA) own posting of its 21 May and 9 June 2026 statements on AI-chip smuggling and tighter controls · Not found · the searches

The searches: Both dated MOEA bulletins were read. The 21 May bulletin’s six news articles concern factory registration, wages, energy efficiency, drones, food trade and a dialogue with Sweden, and none is the statement on AI-chip smuggling. The 9 June entity-list article is a different event, already recorded. Searches in Chinese of the ministry’s and the trade agency’s sites found neither statement. That does not show that they were never made.

3. Japan: any Japanese government statement on chip location verification or AI-chip-specific end-use rules (2025–2026) · Not found · the searches

The searches: Further searches of Japan’s Ministry of Economy, Trade and Industry (METI) in Japanese found no other Japanese chip-location requirement or AI-chip-specific end-use rule. An alternate copy of the economic-security action plan and the re-export FAQ could not be opened. The search results concerned US controls, general re-export procedures or manufacturing-site security, and none describes a new Japanese AI-chip requirement.

4. India: any Indian rule on AI-chip end use or export control, and the US-India Interim Agreement text · Not found · the searches

The searches: The Office of the United States Trade Representative’s (USTR) India index lists the February framework without a signed interim-agreement text. A Ministry of Commerce and Industry written reply to Parliament, published by India’s Press Information Bureau (PIB) on 21 July 2026, says negotiations are ongoing (Annexure I note). That reply dates the absence, but it cannot show the status on 8 October. Searches of the ministries’ sites found no other Indian AI-chip end-use rule and no later signed text.

5. Philippines: text of the US-Philippines Agreement on Reciprocal Trade and any export-control clause · Not found · the searches

The searches: Neither USTR’s agreement index nor searches of Philippine government sites found an agreement text. USTR’s 2026 National Trade Estimate, released 31 March, says the Philippines had not entered a reciprocal-trade agreement containing commitments to address the market distortions discussed there (printed page 418; PDF page 426). That statement predates October, so it cannot show that no agreement exists now, and it gives no export-control conditions.

6. Thailand, Vietnam, Indonesia, Cambodia, Philippines: national permit regimes or official statements specific to US AI-chip transshipment (2025–2026) · Not found · the searches

The searches: Searches in each country’s language covered all five, and further Thai, Indonesian, Khmer and Philippine searches found no other national permit for AI-chip transshipment. Thailand’s National Intelligence Agency published a digest on 9 May 2026 that attributes its allegations to Bloomberg, includes the companies’ denials and states no Thai permit requirement. Vietnam’s Decision 1671, already recorded, directs future export-control policy on sensitive AI, and the Indonesian report describes US controls. Searches cannot show that a country’s law contains no such permit.

7. EU institution statement on AI-chip location verification, kill switches, or hardware-enabled mechanisms (incl. any Commission reaction to the US Chip Security Act), 2025–2026. None found. · Not found · the searches

The searches: Two Commission answers to Parliament address the AI Diffusion tiers and EU access to chips. The Commission’s 2026 Rolling Plan for ICT Standardisation, a working document, requests standards for device trustworthiness, counterfeit prevention and traceability. Its chapter on trusted and secure chips, read in full, specifies no mechanism for chip location, remote disablement or export enforcement.

8. The content of the “technology security requirements in line with those of the United States” that the EU said it plans to adopt (EU-US Joint Statement, 21 August 2025, point 5), and whether any implementing text exists. · Not found · the searches

The searches: The 2026 dual-use change note was read in its official copy. Searches for the Joint Statement’s exact phrase found no implementation of its technology-security requirements.

9. UAE domestic export-control instruments: Federal Decree-Law No. 43 of 2021 on Commodities Subject to Non-Proliferation, Cabinet Resolution No. 97 of 2024 (Executive Regulation) and Cabinet Resolution No. 156 of 2025 (On the Schedule of Goods Subject to Control and Non-Proliferation); whether they control advanced computing items or US-origin AI chips · Unverified · the searches

The searches: Resolution 156/2025 and the schedule it adopts are on the regulator’s site. The schedule lists neural-network integrated circuits (3A001.a.9) and defines neural computers (4A004). Whether any marketed GPU falls under these entries is unverified. The resolution’s Gazette publication and current status are also unverified. The regulator dates it 14 November 2025 without saying what the date marks, and the federal legislation portal could not be opened. Decree-Law 43/2021 and Decision 97/2024 let the authority seize unlisted commodities suspected of a prohibited use or bound for a sanctioned end user. Decision 97 requires officers, during searches, to inspect commodities by technical means to verify their nature and location.

10. Primary text and current status of Saudi Arabia’s draft Global AI Hub Law (the Communications, Space, and Technology Commission \[CST\], April 2025): governing law for hubs, Saudi access/inspection rights, security conditions; whether enacted by October 2026 · Unverified · the searches

The searches: CST’s consultation announcement is still the only record found. The official bilingual draft has a known address, but it could not be opened. An Umm Al-Qura entry with the exact title describes the 2025 consultation; its text could not be opened, and it is not an enactment notice. No official enactment text was found. The draft’s clauses on inspection, governing law and chip security remain unverified.

11. Any Saudi domestic instrument on export, re-export or end-use control of advanced computing items, or a data-centre security standard tied to imported chips · Not found · the searches

The searches: Arabic-language searches of Saudi government sites found no domestic instrument on the export or end use of advanced computing items. They turned up no relevant primary document to read, so this rests on the search results alone.

12. Kuwait and Oman: official texts of AI-chip deals with security conditions (2025–2026) · Not found · the searches

The searches: Searches of official sources found no Kuwaiti or Omani AI-chip deal text with security conditions, and no relevant primary document to read.

13. 2026 US-Saudi follow-on instruments or new Humain export licences (any action after the 19 November 2025 authorisation, e.g. a Saudi equivalent of the UAE Country Group A:5 rule) · Not found · the searches

The searches: No 2026 export authorisation for Humain and no US-Saudi chip-security instrument was found. Reports of commercial cooperation on AI centres describe no export licence.

14. AMD statements on chip location verification, tracking or kill switches · Not found · the searches

The searches: No AMD statement on AI-chip location verification, export tracking or a kill switch was located. AMD’s 13 October 2025 OpenPRoT article was read in full: its backdoor discussion concerns transparency of an open firmware project. It does not address location tracking or export-enforcement mechanisms in AMD accelerators.

15. Hyperscaler (Google, Amazon, Oracle, Meta) statements on chip location verification · Not found · the searches

The searches: The four companies’ sites gave no further statement on chip-location verification, and no relevant company page was found to read.
